This Privacy Policy (“Policy”) describes the types of information we may collect from you or that you may provide when you visit www.halopets.com (our “Site”), use any features on our Site, or create a registered account (“Account”), and our practices for collecting, using, maintaining, protecting, and disclosing that information.

If you do not agree with our policies and practices, do not use our Site or make purchases from it. By accessing or using our Site, you agree to this Policy. This Policy may change from time to time. Your continued use of this Site after we make changes is deemed to be acceptance of those changes, so please check the Policy periodically for updates.

Children Under the Age of 13

Our Site and our products (“Products”) are not intended for children under 13 years of age. No one under age 13 may provide any information to or on the Site. We do not knowingly collect information from children under 13. If you are under 13, do not use or provide any information, register an Account, enter any subscriptions, make any purchases, or use any of the interactive or public comment features of the Site, or provide any information about yourself to us, including your name, address, telephone number, email address, or any screen name or username you may use. If we learn we have collected or received personal information from a child under 13 without verification of parental consent, we will delete that information.   • Automatically as you navigate through the site. Information collected automatically may include usage details, IP addresses, and information collected through cookies, web beacons, and other tracking technologies.

Information You Provide to Us 

The information we collect on or through our Site may include:

  • Information that you provide by filling in forms on our Site, including information provided at the time of registering an Account, signing up for our loyalty program, purchasing Products or a subscription, posting or submitting material or questions, or requesting further services. We may also ask you for information when you report a problem with our Site.
  • Records and copies of your correspondence (including email addresses), if you contact us.
  • Details of transactions you carry out through our Site and of the fulfillment of your orders. You may be required to provide financial information before placing an order through our Site.
  • Your search queries on the Site.
  • Product ratings and reviews.

Third-party ad technology providers, including advertisers, ad networks and servers, content providers, and application providers, may use cookies alone or in conjunction with web beacons or other tracking technologies to collect information about you when you use our Site. This allows us to provide you with interest-based (behavioral) advertising or other targeted content. The information they collect may be associated with your PI or they may collect information, including PI, about your online activities over time and across different websites and other online services.

We do not control these third parties’ tracking technologies or how they may be used. If you have any questions about an advertisement or other targeted content, you should contact the responsible provider directly. However, you have the right to opt out of sharing information with third parties for the purposes of sale and targeted advertising.   • To present our Site and its contents to you.
  • To process purchases you make, but we do not directly process any payment information, which is processed directly by our third-party payment processor.

  • To fulfill any other purpose for which you provide it.
  • To provide you with notices about your Account/purchases.
  • To carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection.
  • To notify you about changes to our Site or any Products or services we offer or provide though it.
  • To allow you to participate in interactive features on our Site.
  • In any other way we may describe when you provide the information.
  • For any other purpose with your consent.

Disclosure of Your Information

We will not rent, sell or share your PI with third parties except as described herein. If you do not want us to use or disclose PI collected about you in the ways identified in this Privacy Policy, you may choose not to use our Site or provide your  PI at any time.

We may disclose aggregated information about our users, meaning information that does not identify any individual, without restriction.

We may disclose PI that we collect or you provide as described in this Policy:

·      To contractors, service providers, and other third parties we use to support our business and our Site.

·      To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which PI held by us about users of our Site and our services is among the assets transferred.

  • To enforce or apply our Terms of Use Agreement and other agreements, including for billing and collection purposes.
  • If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of us, our customers, or others. This includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk protection.

Your Rights

Your rights and choices vary by the jurisdiction in which you reside. Depending on where you live, you may have the ability to:

·      Access your PI, including receiving a copy in a portable format.

·      Correct inaccurate PI.

·      Delete certain PI.

·      Limit the use of your sensitive PI.

·      Not be discriminated against for exercising your privacy rights.

Choices About How We Use and Disclose Your Information

We strive to provide you with choices regarding the PI you provide to us. We have created mechanisms to provide you with the following control over your information:

  • Tracking Technologies and Advertising. You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. If you disable or refuse cookies, please note that some parts of this site may then be inaccessible or not function properly.
  • Promotional Offers from Halo. If you do not wish to have your email address or contact information used by Halo to promote our own or third parties’ products or services, you can opt out by sending us an email to support@halopets.com. If we have sent you a promotional email, you may send us a return email asking to be omitted from future email distributions. This opt-out does not apply to information provided to Halo as a result of a product purchase, warranty registration, product service experience, or other transactions.
  • Opting out of Targeted Advertising. There are a few ways for you to opt out of targeted advertising. If you have an Account with us and would like to opt out of our sharing your PI for targeted advertising, please visit the “Do Not Sell or Share My Personal Information” section of our Site located at [https://privacy.halopets.com/]. If you do not have an Account with us, please write to us at 12400 Race Track Rd, Tampa, Florida, 33626 or send us an e-mail to support@halopets.com. You may also use the Network Advertising Initiative (“NAI”) opt-out tool currently available at http://www.networkadvertising.org/choices/, and you may choose to control targeted ads you receive within apps by using the settings and choices made available to you by your device manufacturer.

If you have an Account with us, you can also review and change certain PI, such as contact email address or shipping address, by logging into your Account on the Site.

Exceptions apply to all of these rights, but if we deny your request, we will tell you why. Depending on where you live, if we deny your privacy request, you may appeal our decision.

Notice to California Users

Pursuant to California Civil Code Section 1798.83, also known as the "Shine The Light" law, California residents have the right to request in writing from businesses with whom they have an established business relationship: (i) a list of the categories of PI, such as name, address, e-mail address, and the type of services provided to that individual, that a business has disclosed to third-parties (including affiliates that are separate legal entities) during the immediately preceding calendar year for the third parties’ direct marketing purposes, and (ii) the names and addresses of all such third-parties. To request the above information, California residents can e-mail us at support@halopets.com  or write to us at [ADD ADDRESS]. Please note that, under California law, a business is only required to respond to such a request twice in any calendar year.

Data Security

We have implemented measures designed to secure your PI from accidental loss and from unauthorized access, use, alteration, and disclosure. All information you provide to us is stored on our secure servers behind firewalls. Any payment transactions will be encrypted or processed directly by a third-party payment processor.

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Site such as your Account, you are responsible for keeping this password confidential. We ask you not to share your password with anyone. The information you share in any public areas of the Site, if any, may be viewed by any user of the Site.

Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your PI, we cannot guarantee the security of your PI transmitted to our Site. Any transmission of PI is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Site.

Document Retention

We retain PI for as long as needed or permitted for the purpose(s) for which we obtained it, and as consistent with applicable law. The criteria used to determine our retention periods include:

  • How long your PI is needed to provide our products and operate our business.
  • How recently you made a purchase from us.
  • Whether you have an Account with us.
  • Whether we are legally or contractually required to maintain your information for a certain period of time.
  • Other legal considerations (e.g., statutes of limitations).

Changes to Our Privacy Policy

It is our policy to post any changes we make to this Policy on this page. If we make material changes to how we treat our users’ PI, we will notify you by email to the email address specified in your Account and/or through a notice on the Site. The date this Policy was last revised is identified at the top of the page. You are responsible for ensuring we have an up-to-date active and deliverable email address for you, and for periodically visiting our Site and this Policy to check for any changes.

SMS Policy

By signing up via text, you agree to receive recurring automated promotional and personalized marketing text messages (e.g. cart reminders) from HaloPets at the cell number used when signing up. Consent is not a condition of any purchase. Reply HELP for help and STOP to cancel. Msg frequency varies. Msg & data rates may apply.
